We advise and represent clients on any matters relating to the codes of conduct which regulate professions or are laid down or enforced by statutory bodies.
The work ranges from technical breaches of rules to serious allegations of dishonesty. We have a reputation for ensuring matters are resolved without the need for litigation. However, we also have the expertise to conduct long and complex contested matters. The breadth of work includes investigations by the:
- Financial Services Authority (FSA)
- Department of Trade and Industry (DTI)
- Serious Fraud Office (SFO)
- Office of Fair Trading (OFT)
- Revenue and Customs (HMRC)
- Health and Safety Authority (HSA)
We have a complete understanding of investigatory, audit and prosecution work for the governing authorities themselves. This includes assisting organisations as diverse as the:
- Law Society
- Institute of Legal Executives
- Architects Registration Board
- General Dental Council
- Taxation Disciplinary Board
We advise not only on matters of general policy but also carry out investigations and prosecutions in specific matters.
Where Disciplinary Tribunal findings have been challenged we have been retained in High Court and Court of Appeal hearings, thus providing a complete service to individuals and organisations. Our breadth of experience and technical ability has long been recognised by fellow professionals in a range of Judicial Review proceedings.
We provide advice and assistance to companies, company directors, officers and individuals in respect of the recent changes relating to:
- Competition Law (and in particular price-fixing and cartel operations)
- Proceeds of Crime Act matters
- New offences regulated by the Financial Services Authority
We also have experience of advising clients about the new corruption offences recently enacted under the Anti-terrorism, Crime and Security Act 2001
We have advised nationwide organisations, companies and individuals as to contested and appeal matters relating to Licensing under the new Licensing Act 2003.
We are also retained by the Federation Against Copyright Theft (FACT) and other organisations in the protection of Intellectual Property Rights through the criminal and civil courts of major film/media companies, BSkyB and the Barclays Premier League.
Other work undertaken by the department includes Asset Recovery Agency matters, and investigations relating to Actuaries.
